Please read the following terms and conditions carefully before making a reservation.
Mediation Terms and Conditions of My Holiday Reisecenter GbR
Dear Customers,
The following mediation terms govern the contractual relationship between you – hereinafter referred to as the "Customer" – and My Holiday Reisecenter GbR (partners: Ayfer Leylek and Cumali Leylek), hereinafter referred to as "My".
They apply to the mediation of contracts for holiday homes ("Feriendomizile") between the Customer and the respective owner/landlord.
Please read these terms carefully.
1. Role of My as an Intermediary
1.1 My acts solely as an intermediary and arranges rental contracts for holiday homes on behalf of the respective owner/landlord.
My is not a tour operator within the meaning of §§ 651a ff. BGB or EU Directive (EU) 2015/2302.
1.2 The rental agreement is concluded exclusively between the Customer and the owner/landlord.
2. Booking Process
2.1 Bookings may be made orally, in writing, by telephone, via email, WhatsApp, or through the website.
2.2 The rental agreement is considered concluded once the Customer receives the booking confirmation from My.
3. Payment Handling
3.1 My is authorized by the landlord to collect all payments (including cancellation fees).
3.2 A deposit of 20% of the total rental amount is due within 10 days after the booking confirmation unless stated otherwise.
3.3 The remaining balance becomes due as specified in the booking confirmation.
4. Customer Cancellation
4.1 There is no statutory right of withdrawal.
The landlord grants a contractual cancellation right under the following flat-rate fees:
- Up to 57 days before arrival: 20%
- 56–36 days before arrival: 50%
- 35–4 days before arrival: 90%
- From 3 days before arrival or in case of no-show/early departure: 100%
4.2 All cancellation notices must be submitted to My.
5. Cancellation by the Landlord
5.1 In cases of force majeure or if the property becomes uninhabitable, the landlord may terminate the contract in accordance with legal regulations.
6. Unused Services
6.1 There is no refund for late arrival or early departure.
7. Security Deposit
7.1 The landlord may request a security deposit as stated in the property description.
8. Entry & Travel Requirements
8.1 The Customer is responsible for obtaining valid travel documents and checking entry requirements.
8.2 My provides information only if expressly agreed.
9. Customer Obligations
9.1 The Customer must inform My truthfully about all relevant details (number of guests, ages, special needs, etc.).
9.2 The property must be treated with care and left in broom-clean condition.
10. Liability of My as an Intermediary
10.1 My is liable within the limits of legal mediation duties.
10.2 Except for injury to life, body, or health, My's liability is limited to three times the value of the mediated rental amount, unless the damage was caused intentionally or by gross negligence.
11. Obligations Towards the Landlord
11.1 Over-occupancy, changes of guests without approval, pitching tents/parking caravans, and improper use are prohibited.
11.2 Pets are allowed only with prior approval.
12. Limitation Period
Claims arising from the mediation activity are subject to the general statutory limitation period (usually 3 years).
Customers are requested to report any defects immediately.
13. Applicable Law & Jurisdiction
13.1 German law applies.
13.2 For claims brought by My against a consumer, the jurisdiction is the customer's place of residence.
13.3 For business customers, the place of jurisdiction is My's registered office.
